Women Sues for 350,000 Over Contracting Herpes
A 33 year old Delavan women has accused a 35 year old man of knowingly giving her herpes and is sueing for $350,000 in restitution for personal injury.
Both her, and the man accused, were both married at the time of the infection and she says that because he was aware of his condition he should pay restitution for her medication and suffering from the disease.
She has filed the lawsuit without legal representation and is trying to get the money from his home owner and auto insurance.
Whether he did infect her knowingly with a life long disease or not there is no specific law in Wisconsin that pertains to this sort of thing as there is in other states, which will make the case hard to win. Also in my opinion they will have to prove that she didn't contract the disease before hand as herpes can sometimes lay dormant or show very little symptoms for years.
The man has denied giving the woman herpes. He has told her to check with her other partners. The woman said her only partners were the man accused and her husband of eight years.
This may be hard to believe though as she was having an affair when she contracted the disease so whos to say he was really the only one.
The husband has refrained from any kind of normal relations with his wife as he doesn't want to contract the disease.
